Army withdraws Birther’s orders (Updated)

Apparently, the Army withdrew the movement orders for Major Stefan Cook, the fella we wrote about yesterday who refused to deploy to Afghanistan based on his belief that President Barack Obama isn’t a US citizen. According to the Columbus Ledger-Enquirer;

Lt. Col. Maria Quon, U.S. Army Public Affairs Officer, U.S. Army Human Resources Command-St. Louis, said Tuesday evening Cook was no longer expected to report Wednesday to MacDill Air Force Base in Florida for mobilization to active duty.

Cook is an Individual Mobilization Augmentee, meaning he is a reserve soldier assigned to an active component unit for duty. He is assigned to the U.S. Army Element of U.S. Southern Command. Last week Cook filed a request in federal court through his California-based attorney, Orly Taitz, seeking a temporary restraining order and status as a conscientious objector.

So, Major Numbnuts avoided some jail time, and the Obama Administration renews the paranoia from the birthers. I can hardly blame the Army wanting to be free of the antics of Orly Taintz, Cook’s dentist-turned-real estate agent-turned-lawyer-turned crackpot nirther, but they must realize how this makes the whole thing look.

Me? I’m more concerned about the impending health care atrocity and the deficit. And Cook is still a criminal and the Left is still hypocritical for not supporting him.

Speaking of hypocrisy, Keith Olbermann named Cook and Taint the “worst person in the world” for being “an embarrassment to all those who have served without cowardice.” I don’t remember him calling any other evader “worst person in the world”. And then some how Olbermann makes it about “Don’t Ask, Don’t Tell” like his buddy Jon Soltz would, I’m sure.

Returning now to the news of Cook’s “victory”, here’s the reported explanation for the Army’s decision:

Earlier today, Quon said Cook submitted a formal written request to Human Resources Command-St. Louis on May 8, 2009 volunteering to serve one year in Afghanistan with Special Operations Command, U.S. Army Central Command, beginning July 15, 2009. The soldier’s orders were issued on June 9, Quon said.

“A reserve soldier who volunteers for an active duty tour may ask for a revocation of orders up until the day he is scheduled to report for active duty,” Quon said.

In short – Cook never had to go in the first place. Unlike most soldiers who deploy as part of a unit, Cook – a reservist – had volunteered to go as an individual augmentee. The Army generally seeks volunteers to fill such assignments first – if no one does so then a non-volunteer is tapped.

So it looks like he volunteered for a deployment just to make a federal case out the birth certificate. That still doesn’t let the Left off the hook, though.

    Not at all, and I agree with you on that. But I think this one was more the route of the lady that showed up for deployment with her kids. Better to shut it all down than to make a scene.

    I am not so sure why you are heaping scorn on “nirthers”?

    Does the fact that Obama is spending huge heaps of money suppressing these claims not interest you? Seriously, why won’t he just put it to bed once all if it is such a loser issue?

    I usually love your take on things but I find your spin on this issue to be a bit disheartening. Cook may be totally wrong, but this latest stunt seems to have at least got the issue a lot more publicity than other incidents have! I don’t expect this to go away anytime soon.

    Maybe I am missing something?

    This thread is officially worthless without pics (of Jonn’s GF). That being said, it’s a lot easier to initiate Art 15 or CM proceedings here rather than while deployed. Think that might have something to do with it? In any event, nothing got resolved and his career is screwed. And yes, Code Pink’s/IVAW/WCW/et al’s mysterious absence is very telling indeed.

    I was wondering the same thing but then I thought “Court martial or artical 15 for what” He was challenging his deployment, his orders were recinded prior to deployment so he didn’t actually refuse or miss a deployment. What would they get him for? You’re right, his career is toast and probably should be but I think the whole situation is only more odd especially with that dingbat lawyer in the news more.

    Let me qualify this by saying the Maj. should have deployed, the POTUS isn’t going to whip out his B.C. just because some pissant Major asks for it. It’s as silly as that Lt. from the left coast refusing deployment because it was an “illegal war” where was Olberman on that one? As I recall, he got off scot free as well and wasn’t even the worse person in the world……..

    I’ll weigh in on this, even though I’m not impressed with “the one” spending gobs of money to keep his bc, college transcripts, all his private sector work (other than community agitator work) under wraps.

    As I have held all along with the cowards who are “resisting” due to their own interpretation of what is legal, or illegal, concerning our wars in A-stan and Iraq; the Major needed to just stfu and do his fricken job. Refusing deployment based on the bc isn’t doing anyone any good. Let his “lawyer” duke it out while he’s deployed and that’s that. The Major is showing the same qualities as the others that refused to do what they volunteered to do.

    I don’t have the least bit of sympathy for someone that gets their nuts in the ringer for refusing to deploy based on bs reasons. If they were drafted, that’s a little different, but this is an all volunteer force and you dance when and where they tell you, once you sign on the line and raise your hand. Honor is a word that has taken an ass whoopin these days, because cowards and their enablers use it as their buzzword for the actions, or lack thereof, of those that refuse to hold up their end of the bargain. It’s not honorable to say you will do something, then, when it looks like you might actually have to do it, you get a case of the chickensh*ts, and “resist” doing what you said you would.

    All the excuses in the world will not get you the honor title, especially from me.

    I think it’s safe to say that, obviously, Obama’s birth cert is, in some way, not on the up and up with this news merely hyper-reinforcing it. Whether it’s worth chasing down in this political climate is debatable, however. (That said, Prez Biden or Pelosi would be *better* than Obama since BIden is an obvious idiot and the whole world would know it within a week of him taking office thus rendering him utterly impotent in the role, and Pelosi is liked by nearly nobody outside of her district so she’d be useless–and thus good for the country–in the office.)

    Frankly, I agree with Sporkmaster on this. I think it’s absolutely shitty that if an officer refuses to deploy, they get off with slaps on the wrist, and everyone assumes that they’re doing it for noble political reasons. However, if an enlisted guy refuses to deploy, they get jail time. When’s the last time they sent an officer to jail for refusing to deploy? With higher rank is supposed to come higher responsibility, not higher immunity from prosecution.

    Actually, I think if the Pres is smart (and devious) he would let the Major off without even a slap on the wrist, maybe even let him do his deployment on some cushy stateside base.

    That would drive the birthers crazy with rumors of ‘Cook was too close to the truth!’

    The sad fact is that the birthers have a negative effect on genuine critics of the president, just as those 9-11 truthers made the anti-war protesters look unbalanced as well.

    Here’s the telling part of the story to me:

    The major should’ve stood on principle on May 7th, instead of volunteering for orders on the 8th.

    Just to clarify, if the ridiculous turned out to be true the election of Obama would be nullified and the second highest Electoral College Presidental ballot reciever would become POTUS, and that would be McCain. Biden would remain VPOTUS. Although it is mostly a formality the Electoral College does actually cast seperate Presidential and Vice Presidential ballots, although both are cast by the same representative to the Electoral College, and thus the ballots for POTUS and VPOTUS are usually identical or within one vote.

    The Birth Certificate thing is entertaining but something of this magnitude could never be kept secret. If Obama was truly born in Mombasa, Kenya I have no doubt Al Qaeda would have gotten to it and released in on their website by now. Imagine the world choas if Obama was found to be unqualified to have become POTUS and the meltdown in the democratically controlled congress over whether John McCain should be installed as POTUS, let alone all the legistation, execultive orders and appointments that would instantly nullified. With no POTUS we, and many other nations, would be wide open to a nuclear strike without the US being able to effectively respond. There are just too many global entities that would desire paralyzing chaos in the US for a secret like this to be kept, at any price.

    That’s my 2 cents.

    The Major is just taking one for the team: in order to have the SCOTUS hear the issue and compel BO to produce the actual birth certificate, the plaintiff must have standing to sue. The SCOTUS clearly indicated that only an active duty would qualify – the last case they refused to grant cert to had several retired general officers. In this case, the lawyer already has one active duty plaintiff – an LT who is already in Iraq. With Cook, they would have had it covered on both sides – an active duty who is deploying. So, this is not an attempt to duck the deployment.
    If I was a conspiracy nut, I would say that the fact that the Army revoked his orders clearly indicates the WH desire not to get this case in front of the SCOTUS that would ultimately result in the order to produce the actual certificate.
    I guess, the left and IVAW & Co are not behind Cook because he is not claiming the wars are illegal, only his orders to go to war are illegal…He is not anti-war enough…

    I have deeply mixed feelings, I must admit.

    Reckon I’m sort of a Birther in that I do feel there are un-answered questions about where Obama was born. However, the time ask these questions, and demand answers, was BEFORE the election. And the results made public. Once he was elected the context shifted.

    BUT Jonn’s update sheds some light on aspects that taint this whole thing.

    Disclaimer: Several of my best friends are what you here call ‘birthers’ – with several CIBs and other awards denoting service of note amongst them.

    He did. He produced an official Hawaii document showing where and when he was born, which is valid for any legal purpose requiring such proof. The thing is, the birthers keep moving the goalposts. Nothing will satisfy them.

    However — If there is a possibility that 0bama is not qualified and some are bringing the issue to the front burner — why would you attack them as they make progress? Couldn’t you back off on the liberal type attacks and just wait to see what happens?

    You may think it is a petty issue now, but do you have another issue that can stop 0bama?

    I know you don’t support everything that Obama wants to do, and you would like to stop him. Keeping the conservative movement together now is not the right action to take — stopping 0bama is. Conservatives can regroup under a Biden presidency.

    I think it is very funny how WND is running this story since they certified BO’s BC before the election, it is still available on their website.
